1. Acceptance of Terms

By accessing ergonhvac.com or engaging Ergon HVAC (“Ergon HVAC,” “we,” “us”) for HVAC services, you agree to these Terms of Service. If you do not agree, please do not use our website or services.

2. Services Provided

Ergon HVAC provides residential and commercial heating, ventilation, air conditioning, and indoor air quality services throughout Connecticut. All services are performed by licensed, insured, NATE-certified technicians.

Service availability varies by location. Estimates provided through our website, phone, or in-person are for informational purposes. Final pricing requires an on-site assessment and written proposal.

3. Estimates & Pricing

• Online estimates and calculators provide budgetary guidance only and do not constitute binding quotes.
• Final pricing is determined after a Manual J load calculation, site inspection, and equipment selection.
• All proposals are valid for 30 days unless otherwise stated.
• Prices are subject to change based on material costs, permit fees, and unforeseen conditions discovered during installation.

4. Payment Terms

• Payment is due upon completion of work unless financing or other arrangements are agreed to in writing.
• We accept cash, check, major credit cards, and financing through approved third-party lenders.
• Deposits may be required for custom equipment orders or large-scale projects.
• Late payments may be subject to finance charges as permitted by Connecticut law.

5. Warranties & Guarantees

• Manufacturer Warranty: All equipment carries the manufacturer's standard warranty. Registration is required for full warranty coverage.
• Labor Warranty: Ergon HVAC provides a minimum 1-year labor warranty on all installations. Extended labor warranties are available.
• No Lemons Guarantee: If a compressor or heat exchanger fails twice within 5 years, we replace the entire system at no charge. Terms apply.
• Comfort Guarantee: If your new system does not maintain the promised temperature differential, we will modify or replace the system within the first year.

6. Cancellation & Refunds

• You may cancel scheduled service with 24 hours notice without penalty.
• Custom-ordered equipment is non-refundable once ordered from the manufacturer.
• Refunds for completed work are evaluated on a case-by-case basis under our satisfaction guarantee.
• Connecticut Home Improvement Act: You have 3 business days to cancel any home improvement contract signed in your home.

7. Limitation of Liability

Ergon HVAC is not liable for:

• Damage resulting from pre-existing conditions in your HVAC system, ductwork, or electrical infrastructure
• Issues caused by failure to follow recommended maintenance schedules
• Consequential damages beyond the cost of our services
• Performance issues resulting from changes to your home's thermal envelope after installation

8. Website Use

• Content on ergonhvac.com is for informational purposes. While we strive for accuracy, we make no warranties about completeness or currentness.
• You may not scrape, reproduce, or redistribute our content without written permission.
• Our site may link to third-party websites. We are not responsible for their content or practices.

9. Governing Law

These terms are governed by the laws of the State of Connecticut. Any disputes shall be resolved in the courts of Fairfield County, Connecticut.
